Deputy’s Actions Reasonable not CriminalWritten by Theresa Rose on September 26, 2015
Friday the Iowa Department of Public Safety released the findings of an investigation into the Sept. 13 shooting death of 39-year-old Martin Hammen outside his home near Wellman.
The investigation shows Sgt. Kirk Bailey shot Hammen after the man raised a gun toward Baily and another officer. The officers asked Hammen to put down his weapon and he failed to comply.
Several hours before the shooting, the officers responded to a call reporting Hammen as suicidal but could not locate him. Deputies returned around 1:15 a.m. because Hammen’s house and other buildings on his property were on fire.
Officials say Bailey’s action was reasonable under the circumstances.
